Value Proposition
The Problem With Traditional Founder Dispute Resolution Options
Challenge
When founder disputes arise, they are often fraught with both difficult legal and interpersonal issues. The stakes are high, given founders usually have poured everything into their companies. But traditional litigation is a poor match for startups. Litigation is expensive, can take years to resolve, can scare off investors, and destroys value.
Solution
At SOLVD4, we offer a streamlined mediation service that does not require lawyers. We meet with the parties, get an understanding of the dispute, and mediate a mutually-agreeable solution that preserves value and is a win-win. Because we know startups and know startup disputes, we can provide a neutral assessment of the strength and weaknesses of each founder’s position and propose practical resolutions.
Our Process
How Does It Work?
Step One
Each founder has an introductory call with a Solvd4 mediator to explain their perspective and goals.
Step Two
Each founder can submit any written materials to the Solvd4 mediator for review.
Step Three
On the day of the mediation, the Solvd4 mediator meets with both founders and works to negotiate a mutually agreeable resolution.
FAQ
Frequently Asked Questions
do i need to hire a lawyer to participate in a solvd4 mediation?
A lawyer is not required to participate in a SOLVD4 mediation. But SOLVD4 is not a law firm. And even though a mediation might be evaluative, SOLVD4 mediators do not provide legal advice. If you are seeking legal advice, we recommend you see a lawyer.
Is a solvd4 mediation confidential?
Yes! Everything you say to your SOLVD4 mediator will be held in strict confidence. That being said, we encourage each founder participant to allow their mediator to share as much information as possible with the other participating founder, as it helps to facilitate a resolution. Generally speaking, statements made during mediation cannot be used against you in litigation - which helps make it easier to share information. But your SOLVD4 mediator will not share with other mediation participants any information that you director him or her to keep secret.
Why should I mediate when I might be able to get more in litigation?
It's entirely possible that you could get a better result, in some senses, in litigation than in a SOLVD4 mediation. But you will spend a lot more money and a lot more time getting there. And it's a gamble. Litigation is unpredictable. You can win big or lose big or anything in between. Litigation can scare off investment and preoccupy time and energy better spent on creating value. And litigation, depending on the forum, is public. Mediation, on the other hand, is quick and efficient. It's confidential. And importantly, it's flexible. Courts are constrained by the tools available under law. The best resolution might not be zero-sum. A SOLVD4 mediator, on the other hand, can use their skill and experience to facilitate creative resolutions that can be a win for everyone.
What is your fee structure? Do you charge by the hour?
All SOLVD4 mediations are done at a flat fee that is divided equally between the parties. We do not charge any hourly fees for our mediation services.
Is a solvd4 mediation binding?
SOLVD4 mediations aren't binding. Your SOLVD4 mediator will not issue any decision or judgment. Our job in a mediation is to help the parties arrive at a mutually agreeable resolution.
Why do I have to set aside a half or whole day for a mediation? Why can't this all be done by email or through phone calls?
At SOLVD4, we have significant mediation experience. We also have at least as much resolving disputes outside of mediation. While both can work, a dedicated period of time (whether it be a half or whole day) that the parties set aside for mediation is the most efficient way to resolve a dispute and creates momentum towards settlement.
